Individual Entrepreneur Tochenova Eleonora Yuryevna, hereinafter referred to as the “Operator”, publishes this Privacy Policy, hereinafter referred to as the “Policy”, in relation to personal data subjects, hereinafter referred to as the “User”, who use the website located at neartogether.com, including its language versions, hereinafter referred to as the “Website”.
Through the Website, the Operator provides intermediary services for arranging, paying for, and supporting orders from local sellers and services in the recipient’s country, with delivery within the recipient’s country, hereinafter referred to as the “Service”.

1. General Provisions

1.1. This Policy contains information on how the Operator collects, processes, and discloses personal information about Users of the Website.
1.2. For the purposes of this Policy, Users are natural persons using the Website, including those placing an order or submitting a request for the provision of the Service, as well as persons sending an inquiry through the Website.
1.3. The processing of personal data is carried out by the Operator in accordance with Federal Law No. 152-FZ of 27 July 2006 “On Personal Data”, hereinafter referred to as “Law No. 152-FZ”, and other regulatory legal acts of the Russian Federation in the field of personal data.

2. Acceptance of the Privacy Policy

  • information about completed payments;
  • other information voluntarily provided by the User when placing an order, submitting a request, or sending an inquiry, including the content of the inquiry.
3.2. The Operator does not request or store the User’s bank card details. The entry and processing of such details are carried out by the bank and the engaged payment service provider.
3.3. Information about the order recipient, if the recipient is not the User, is provided to the Operator by the User. The User independently ensures that there are legal grounds for transferring the personal data of the recipient and other third parties to the Operator and is responsible for providing such data.
3.4. The Operator may additionally collect and process the following information about the User automatically:
  • data about the User’s technical device and its interaction with the Website, including IP address, operating system version, browser type and version;
  • information about the User’s actions on the Website and the date and time of visiting the Website;
  • information automatically received when accessing the Website through cookies.
3.5. The User has the right to refuse the processing of cookies by changing the settings of the browser used. Disabling cookies may result in certain Website functions becoming unavailable.

4.3. Personal data collected through the Website is stored on servers located in the Russian Federation. Data hosting is provided using the infrastructure of Selectel LLC and Yandex Cloud, whose data centers are located in the Russian Federation.
4.4. Personal data is processed for 30 days from the date of receipt if the User refuses to enter into an agreement, or for 5 years from the date of termination of the agreement if such agreement is concluded, unless another retention period is provided by the legislation of the Russian Federation.

5. Purposes of Processing Personal Information

5.1. The Operator processes Users’ personal information for the following purposes:
  • conclusion and performance of an agency agreement entered into under the terms of a public offer posted on the Website;
  • arranging, paying for, and supporting orders from sellers, as well as organizing delivery of the order to the recipient;
  • reviewing and processing orders and inquiries received through the Website, maintaining communication with the User, including through messengers;
  • carrying out settlements, accepting payments, and refunding funds;
  • reviewing claims and resolving disputes;
  • improving the operation of the Website and analyzing statistics on its use;
  • maintaining accounting and reporting records and fulfilling obligations imposed on the Operator by the legislation of the Russian Federation.
5.2. Sending advertising and informational messages to the User is carried out by the Operator on the basis of a separate consent provided by the User and is governed by such consent, as well as by the legislation of the Russian Federation on advertising.

6. Principles of Personal Information Processing

When processing Users’ personal information, the Operator follows the principles below:
Lawfulness, fairness, and transparency. Personal data is processed lawfully, fairly, and transparently; information about the purposes, methods, and scope of processing is presented in an accessible manner.
Purpose limitation. Personal data is collected and used exclusively for the purposes stated in this Policy.

  • to banks and payment service providers, including the Robokassa payment service, for the purpose of processing settlements and accepting payments;
  • to providers ensuring hosting and operation of the Website, including Selectel LLC and Yandex Cloud, to the extent necessary for hosting and operating the Website;
  • to persons providing technical support on behalf of the Operator, as well as accounting and reporting services for the Operator, to the extent necessary for the provision of such services;
  • to state and municipal authorities in cases provided for by the legislation of the Russian Federation.
7.3. When transferring personal data to persons processing such data on behalf of the Operator, the Operator ensures that such persons comply with the requirements of the legislation of the Russian Federation on personal data.
7.4. The Website may contain links to other Internet resources. The Operator is not responsible for the content of such resources or for their processing of the User’s personal information.

8. User Rights

8.1. The User confirms that they have been informed of their rights regarding personal data as provided by Law No. 152-FZ, including the rights:

9. Protection and Destruction of Personal Data

9.1. The Operator takes the necessary legal, organizational, and technical measures to protect personal data against unlawful or accidental access, destruction, alteration, blocking, copying, distribution, as well as other unlawful actions in relation to personal data.
9.2. Upon achievement of the purpose of personal data processing, expiration of the retention period, or withdrawal of consent to processing by the User, provided that further storage of personal data is no longer required, the Operator ceases processing and destroys the personal data within a period not exceeding 30 days, except in cases where storage is required by the legislation of the Russian Federation.

10. Amendments to the Privacy Policy

10.1. The Operator has the right to amend this Policy at any time, provided that no provisions contradicting the legislation of the Russian Federation are included.
